Attorneys Katie H. Storms and João C.J.G. Medeiros prepared an amicus brief to the Minnesota Supreme Court on behalf of the Minnesota Defense Lawyer’s Association (MDLA). The Minnesota Supreme Court issued its opinion on August 12, 2020, fully affirming the position of the Respondent and amicus. Specifically, the Court held that a health care provider who voluntarily declines to intervene in a pending workers’ compensation proceeding after receiving timely and adequate notice of the right to intervene cannot initiate a collateral attack on the compensation award under statute.
